Contract of Sponsorship with Dysnasty Rail Services

This contract sets out the responsibilities of the primary sponsor and the individual (You) following agreement between us for the sponsorship of you under the Sentinel Scheme operated on behalf of Network Rail.

Regardless of the employment status of you, the company through this Contract of Sponsorship shall fulfil the role of the employer for the purposes of health and safety legislation.

As your Primary Sponsor we shall meet our responsibilities under the scheme by:

Providing you with a valid Sentinel Smart Card.
Undertaking an induction briefing with you which will include, as a minimum, the rules and responsibilities of the Sentinel Scheme.
Providing you with suitable PPE, so marked as to identify who you are working for when on the NRMI, and suitable training to be able to use that protective equipment effectively.
Providing you with regular briefings on changes to Network Rail/Railway Industry standards, Rule Book and Sentinel Scheme Rule updates.
Monitoring your training and assessments to ensure competence at required intervals and that this would be provided free of charge.
Providing you with Safety Critical Equipment to enable you to undertake your role (jointly with any Sub-sponsor where appropriate).
Providing you with personal issue information such as handbooks, standards and relevant information.
Providing you with advice, guidance or instruction on any restrictions based on medication and other medical fitness issues.
Ensuring that we mentor and support you to develop your competence.
Having in place clear contractual arrangements between us and yourselves, and whether Sub-Sponsors are permitted.
Monitoring and managing your working hours under our Contract of Sponsorship. Shifts worked with Sub-Sponsors must be considered in the monitoring of working hours and the management of fatigue.
Agreeing any sub-sponsorship arrangements with you and to grant permission to any Sub-sponsor to use our resources.
Undertaking a local investigation process where any suspected breach of the Sentinel Scheme Rules becomes apparent.
Conducting an annual review of your continued suitability to work on the infrastructure considering behaviours and performance of safety critical duties and identify development requirements
Collating information from Sub-sponsors to enable conclusion of the local investigation.
Maintaining records of local investigations and request a formal review where a Scheme Outcome is recommended following a local investigation.
Providing a reason for de-sponsoring you where requested by yourselves.
Conducting a local investigation before de-sponsoring for any breach of the Sentinel Scheme Rules where applicable.
Collating and maintaining all records associated with the Contract of Sponsorship which has been issued to you.
Requesting a temporary suspension pending the conclusion of local investigation where appropriate.
De-sponsor you at your request within five working days.
Ensuring a misconduct hearing is carried out in the event of a breach of the rules.

You shall:

Carry your Sentinel Smart Card at all times while working on NRMI and will co-operate with us to ensure the personal information held in the Sentinel Scheme Database and printed on the Sentinel Smart Card remains accurate.
Follow the rules of personal accountability for working safely on NRMI, including compliance with the Lifesaving Rules, care and correct use of PPE, attendance and compliance with Safety Briefings, Rule Book and Sentinel Scheme Rules updates.
Notify us of any competences or training requirements including recertification courses.
Manage your Sponsor relationships at all times when working on the NRMI and in particular;
Know the identity of your Primary Sponsor.
Know which Sub-Sponsor you are working for (when you are not working for us);
Provide the correct name of the Sponsor you are working for when booking into site.
Notify the Primary Sponsor of any changes in circumstance including health issues, that may require the Primary Sponsor to take action to ensure your continued fitness for work trackside.
Notify your supervisor if you no longer wish to be sponsored by us so you can be de-sponsored. Change of sponsorship can be requested online through My Sentinel.
Co-operate with any investigation into an alleged breach of the Sentinel Scheme Rules by us or your Sub Sponsor.
NOTE: Individuals can access their personal records on the Sentinel Scheme Database. This can be requested from your Primary Sponsor, or by direct access to the My Sentinel area of the Sentinel website.
